US Court Mandates Release of Kilmar Abrego Garcia from Immigration Detention

Courtroom scene

A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks legal authority.

"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her order.

The case stems from a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. Following his repatriation to the United States to answer human smuggling charges, he was held in federal custody.

In her order, the judge noted that the government lacks a valid deportation order, which prevents them from removing Mr. Abrego Garcia "for now."

Background of the Legal Challenge

The legal proceedings involve conflicting assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.

He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing trial in the state of Tennessee.

Conditions of Release

The judge, who was hearing his petition to deportation in a federal court, determined that he must now comply with the conditions of his release from custody in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.

This decision represents a notable development in a complicated legal case involving allegations of mistaken imprisonment and disputed criminal associations.
