Michael Jordan Tells Court He Felt No Fear of Nascar in Antitrust Trial
Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, stated that his competitive side and status as a newcomer motivated his effort with 23XI Racing to “challenge” Nascar over perceived violations of competition laws.
Financial Stakes and a Will to Win
The owner disclosed operational insights of his racing venture, saying he invested $40m of his personal wealth into the Nascar Cup series team launched with partner Polk and longtime driver Denny Hamlin.
“Someone had to step forward,” Jordan said during testimony. “As a newcomer, I wasn’t afraid. I believed I could take on Nascar in its entirety. I felt as far as the sport required examination through a new lens.”
The Core Dispute: Charter Agreements and Contract Pressure
The heart of the case involves the end of a 2016 deal where Nascar granted each team a “charter”. The concept is similar to other professional sports with separately owned franchises, such as the Charlotte Hornets or the NFL’s Panthers. This deal was set to expire in 2024 when Nascar demanded charter membership renewals.
Jordan was on the witness stand for about sixty minutes and exited the courthouse to a media frenzy, with onlookers and reporters clamoring for a view or a photo of the global icon.
Spearheading the Fight
23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to overhaul a operating model Jordan contended is breaking the law to keep two hands on the wheel.
At issue for Jordan and a fellow team representative, who preceded Jordan, are events from September 2024. She recounted a hectic and tense period where the racing circuit informed teams they must sign a contract extension. The document spanned over a hundred pages outlining team compensation and a guaranteed spot in Nascar-sponsored races.
Choosing Litigation
Jordan said that his team and its ally concluded their sole viable path was to refuse a signature that extensive document and litigate the matter. The other 13 organizations agreed to the terms.
Jordan and co-owner Denny Hamlin reached out to Nascar about potential amendments or extension options. Nascar wasn’t talking, according to his testimony.
The Ultimate Motivation: Winning
Ultimately, the resistance against what he saw as a unsustainable system was mostly about the usual bottom line for Jordan: Winning.
“Denny convinced me getting a third driver improved our chances to win,” he said, noting that he purchased another franchise last year for $28m despite the uncertainty. “So I took the plunge.”

Gibbs described her request for permanent charters, submitted in a formal letter to Nascar. She said the timing of the signature deadline didn’t sit well.
According to her, the team founder first attempted to call and persuade Nascar against demanding signatures, but Nascar’s leader declined the request.
“Please don’t force this on us,” Heather Gibbs said was the message to Nascar’s leadership. She said France replied, “Whether I have 20 charters, that’s what I have. If there are 30, that’s the number.”
